Terms & conditions

AGREEMENT

This contract ("THE AGREEMENT") sets forth the terms and conditions of the affiliate relationship between this site and its owners ("Seedsman") and the party requesting enrolment ("AFFILIATE").

ENROLMENT 
 
By providing their information and agreeing to these terms AFFILIATE requests enrolment in Seedsman’s affiliate program. Seedsman reserves the right to refuse enrolment for any reason. Seedsman is not required to notify AFFILIATE if enrolment has been denied, or to provide any explanation.

Following the GDPR regulation, Seedsman does not share any personal details to any other companies.

GENERAL TERMS 
 
By section 6 of the Misuse of Drugs Act 1971 it is an offence to cultivate any plant of the genus Cannabis in the United Kingdom without a license from the Secretary of State. Anyone committing an offence contrary to this section may be imprisoned of fined, or both. 
The AFFILIATE must note that promoting the germination of Seedsman’s cannabis seeds is illegal in the UK and in most other countries. 
Due to certain regional laws, we are unable to deliver our seeds to certain countries. Therefore, if your website is specifically regional, we advise you to check local laws before applying to become an AFFILIATE. 
Seedsman does not wish to induce anyone to act in conflict with the law. All persons who purchase seeds are responsible for their actions in the future. Seedsman will accept no responsibility in this respect. All information contained on any Seedsman promotional material or packaging is for educational purposes only and is not intended to condone, promote or incite the use of illegal and/or controlled substances. 
Likewise, AFFILIATES must not incite the use, cultivation or trafficking of banned substances. 
Seedsman reserves the right to reduce commission levels, commission tiers and affiliate relations at any time for any reason. Where possible Seedsman will try to discuss this with the affiliate beforehand.

LINKS 
 
Seedsman may provide AFFILIATE with links, banners, text, multimedia content, or other snippets (collectively "ADS") to use when promoting Seedsman's product(s). 
 
TRACKING 
 
Seedsman will track referred users ("REFERRALS") based on additional information added to the URL, and/or the referring URL. REFERRAL may be tracked using JavaScript, cookies, IP address, and/or other technologies. AFFILIATE accepts that tracking of referrals is inaccurate. AFFILIATE accepts that they may not receive credit for referrals who have disabled Flash, cookies or JavaScript, customers using advanced Ad Blockers or who in some other way interfere with the normal operation of tracking code. Seedsman may also cancel any transaction, including all commissions owed to AFFILIATE for any reason, including duplicate transactions, suspicious or fraudulent transactions, order returns, or incorrectly assigned transactions, even if the transaction was tracked automatically by the code.

PAY PER CLICK ADVERTISING (PPC) 
 
AFFILIATES may promote Seedsman’s websites using PPC campaigns in various search engines. AFFILIATES acknowledge that promoting cannabis seeds may be not allowed or limited by various search engines and they run their affiliate PPC campaigns on their own risk. AFFILIATES must adhere to search engine company’s Terms and Conditions. 
AFFILIATES are not permitted to use the Seedsman trademarks and website names and domains and in any paid search activity, whether this is in ad text, copy or display URLs. 
 
AFFILIATES are not permitted to bid or appear on keywords that include our trademarks, website names and their domains, as well as their misspellings. Examples of forbidden keywords: seedsman, seedsman seeds, seedsman.com, seedman, sedsman, seeds man, etc.

DEFAULT CAMPAIGN

When the AFFILIATE’s account has been approved, their will automatically be assigned to a default campaign which gives up to 20% commission on approved transactions on selected products. A 90 days cookies policies is applied to all campaigns.

APROVED/PENDING/DECLINED TRANSACTIONS

As soon as an order has been made using an AFFILIATE track link, it will automatically appear on Post Affiliate Pro as “Pending”.

Once a transaction is paid and delivered, the status of the commission will go from “Pending” to “Approved”. Please not this can take time depending on the payment method chosen by the customer.

Once a transaction is aborted, cancelled or returned the status of the commission will go from “Pending” to “Declined”. Please not this can take time depending on the customer’s behaviour.

If a customer is using an advanced VPN/Ad Blocker, transactions might not track, and the commission will get lost. It is to the AFFILIATE to clearly communicate with the customers that they must disable those plugins to get a commission. Any missed commissions due to the use of VPN/Ad Blockers will not be the responsibility of the company

PAYMENT 
 
Seedsman will pay AFFILIATE commissions every month, after the 20th day of a month, for commissions generated up to the last day of a previous month. Affiliate must be owed 100€, or the minimum payout threshold selected in AFFILIATE's account options, to be able to receive payment. AFFILIATES can be paid by PayPal, Bitcoin or direct bank transfer. International bank transfers (outside UK) lower than 200€ are subject to 10€ payment processing fee. Payments are issued in Euros. 
 
CUSTOMERS 
 
AFFILIATE grants that REFERRAL is the customer of Seedsman. Seedsman may attempt to sell additional goods or services to REFERRAL at any time, for any reason. 
 
LICENSE 
 
ADS may contain copyrighted material, trademarks, or other intellectual property. Unless otherwise noted, Affiliate is authorized to use ADS and the content in them for the sole purpose of promoting Seedsman's product(s). THE AGREEMENT in no way implies an exclusive license to intellectual property, license to create or display derivative works, or a license to use any material for any purpose other than promotion of Seedsman's product(s). 
 
DURATION 
 
THE AGREEMENT may be terminated at any time by either party by notifying the other party in writing, by telephone, or via email. Upon termination Affiliate will be paid any commissions owed. Upon termination, Seedsman will no longer pay AFFILIATE any commission for visitors sent, even if Seedsman continues to track AFFILIATE's REFERRALS

MODIFICATION 
 
Seedsman may change this agreement at any time by posting a new agreement here. AFFILIATE's continued use of the referral tracking system shall constitute agreement to the new terms. If AFFILIATE chooses not to accept the new terms, AFFILIATE may terminate THE AGREEMENT as set forth above. 
 
LIMITATION OF LIABILITY 
 
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
